These Terms & Conditions apply to your use of the Kynetx Medical website and to products and services provided by Kynetx Medical Limited (“Kynetx Medical”, “we”, “us” or “our”). Kynetx Medical works with clinicians and healthcare professionals throughout New Zealand to design and manufacture custom orthotic and bracing solutions. This website is primarily intended to provide information to clinicians, healthcare professionals and other customers who work with Kynetx Medical.
2. Information on this website
We make reasonable efforts to ensure that the information provided on this website is accurate and up to date.
However, website content is provided for general information purposes and may be changed, updated or removed without notice.
Product images, colours, measurements and other visual representations are indicative only. Actual products may vary slightly due to materials, manufacturing processes, photography, lighting and individual screen settings.
If you require specific product or manufacturing information, please contact Kynetx Medical directly.
3. Clinical responsibility
Kynetx Medical manufactures orthotic and bracing solutions based on information, measurements, scans, prescriptions and specifications supplied by appropriately qualified clinicians or healthcare professionals.
The prescribing clinician remains responsible for:

assessing the patient;

determining the appropriate clinical prescription;

providing accurate and complete information required for manufacture;

determining the intended use of the device; and

assessing the suitability of the finished device for the patient.
Kynetx Medical does not provide medical diagnosis or treatment advice through this website. Information provided on this website should not be relied upon as a substitute for appropriate professional clinical assessment or advice.
4. Orders and quotations
Clinicians may submit product enquiries and orders through the website or by contacting Kynetx Medical directly. Submitting an order through the website does not, by itself, constitute acceptance of the order or create an obligation for Kynetx Medical to manufacture the requested product. Orders may be subject to quotation, confirmation of specifications and acceptance by Kynetx Medical.
Kynetx Medical may contact the prescribing clinician to clarify prescriptions, measurements, scans, specifications or other information required to manufacture the device. Where a quotation is provided, manufacture will proceed in accordance with the quotation and agreed specifications once the relevant approval or acceptance process has been completed.
5. Invoicing and payment
Kynetx Medical does not process payments through this website. No payment is required at the time an online order or enquiry is submitted. Following acceptance of a quotation and completion of the relevant ordering and manufacturing process, Kynetx Medical will issue an invoice directly to the clinician, practice or other customer in accordance with the agreed terms. Any payment terms stated on the relevant invoice will apply to that invoice.
6. Custom-made products
Many Kynetx Medical products are individually designed and manufactured according to the requirements of a particular patient and the prescription provided by the clinician. Because these products may be made specifically for an individual patient, they may not be suitable for return or exchange simply because the product is no longer required or the patient changes their mind.
If a product has been manufactured incorrectly, does not correspond with the agreed prescription or specifications, or has a manufacturing fault, please contact Kynetx Medical as soon as reasonably possible so that the matter can be assessed and an appropriate resolution determined.
Nothing in these Terms & Conditions is intended to exclude or limit any rights or remedies that cannot lawfully be excluded or limited under New Zealand law.
7. Information supplied for manufacture
Clinicians and other customers are responsible for ensuring that information supplied to Kynetx Medical is accurate, complete and appropriate for the intended patient and clinical application.
This may include:

prescriptions;
-
patient measurements;
-
3D scans;
-
casts or impressions;
-
clinical specifications;
-
photographs;
-
fitting information; and
-
other information relevant to the manufacture of the device.
Where information is incomplete, unclear or requires clarification, Kynetx Medical may contact the prescribing clinician before proceeding with manufacture.
8. Colour and appearance options
Where colour or other appearance options are available, these may be selected from the options offered by Kynetx Medical at the time of ordering. Colours shown on this website are indicative only and may vary depending on lighting, photography, materials and screen settings.
The selection of a colour or appearance option relates to the appearance of the device and does not alter its clinical design, prescription, fit or functional requirements.
9. Intellectual property
Unless otherwise stated, all content on this website is owned by or licensed to Kynetx Medical.
This includes, but is not limited to:
